It's been a while since I've dropped by. I was going through the Collectibles section and noticed there was an Astrodome Wall Clock and the art looked very, very, very, very, very familiar. I know when I put those illustrations out on Flickr I was aware this could happen, but I just hoped people would at least have the common decency to ask if they could use the art for their ventures . I don't believe this seller is a member. In every case it's been a personal project for which I have no problem and haven't turned anyone down yet. I just have an issue when something like the wall clock shows up. Contact the seller and tell them that they don't have your permission to use your artwork or they can pay you X amount of money per clock. OR Contact Ebay and tell them. They will ban the seller.
I have had this happen with me and my teardrop build pictures. I contacted the seller and they pulled my pictures from their ads.

The problem with your assumption is the phrase "common decency". I'm pretty sure any such commodity will be a long lost piece of history by the time my grandchildren show up....a lost art in modern society.

Jay You did that picture! When I first was looking for campers I found that image of an Astrodome and I Loved it, you did a yellow and a teal version as I recall... If you did one in 1956 T-Bird Sage green it would be even better . Fantastic work. Very accurate as well (being an Astrodome owner). I almost got a T-Shirt made (for myself, not sale) with that image on it and thought better of it not knowing who had done the image. Well Done! Please don't let this stop you from continuing to produce and share such great work! and I agree with Ross, you can get them shutdown no problem I would think. Best of luck and thank you for such great contributions to the Shasta community.

I hope retro-rods is toast...I wonder if ebay members can provide feed back about retro-rods, I can see that 100% plummet to about 17% before they throw the jerk out of Ebay all togther. jaydar1968 please start your pursuit of this low-life by getting him off Ebay, then consider going after him in the courts. Gotta sign off for now and sign in to Ebay and see what my options might be...maybe I will start with a question to the seller since he says customize your own clock provide me with a picture and I could ask, I have a pic that dude did of a Compact, do I need to try and erase his signature and that copyright thing or can you do it when you make my clock, since I'm afraid if I do it it will mess up the pic, and see what his answer might be...should change his name to retro-rod-the-rat...imho

He may have "only" sold 2 but how many thousands of viewers are looking at jaydar1968's drawing being used in an ad to sell Rod-the-RAT's clock products accessible to everyone with a computer...jaydar1968's illustration being so fine could very well be stimulating many others to buy using pics of their own camper hoping the result looks as good as jaydar1968's illustration...there is a lot more going on here than a one-off rip-off...intentional copyright infringement is a Federal offense I believe.

If what cowcharge copy/pasted didn't work i would file a complaint with eBay saying that your image is being used by an unauthorized seller etc etc.

They are back at it again! I just reported them to Ebay as selling unauthorized copyrighted material.
Have you contacted Ebay about this matter, Jay?
You can do a quick report by clicking on the REPORT ITEM button just to the right of the Description, Shipping and Payments tabs.

Thank you Ross for the email notifying me about the return of the Shasta clocks. It's been awhile since I've dropped by and was amazed by all the support and comments. After the initial Shasta clock auction had expired I kind of put that issue on the back burner but then forgot all about it.
Thanks everyone for your efforts in curbing these pirates actions. I have sent them an email asking that they discontinue all sale of Shasta clocks with my original art. Who knows, if they had just asked I may have given them permission at no charge. But now...

Oh, and the line in the auction bill that killed me the most: "If the color isnt your exact model your [sic] looking for email me and I will see what I have."

He's put the entire lot back uo for sale. Might be the only way to stop him is to threaten him with a lawsuit. But a complaint to eBay might at least slow him down a little. eBay does take copyright infringement seriously. There should be a link somewhere that says something like "report an item" and you can tell them the whole story. I would definitely follow through on it, what he's doing is just plain WRONG.

Yes right above the item description on the right side of the screen is a "Report Item" link. I have never done it so I cant help anything past that.

Be sure to go to the seller's "other auctions" and then report each and every one of them, he has re-listed them all! I don't think eBay will remove the others if they aren't reported too. Either way, the more noise we make the less likely he'll be to just wait a bit and re-list them again. This especially irks me because I'm both an artist and an eBay seller - an HONEST eBay seller, I just can't imagine pulling this type of crap and getting away with it! Apparently the guy has no scruples whatsoever. Guess we'll have to keep an eye open for the clocks on Etsy and Amazon now...

Dear retro-rods,
Did you get permission to use Jay's artwork for you own personal gain? This is copyrighted artwork that was taken from a website. What you are doing is illegal.
AND this is his response from the seller, Jim.

You should be able to back that up. I created that artwork. That photo of the airflyte is of a diecast image. I am a graphic artist and used my own software programs to create the lettering, etc. I have closed the auction until you can provide proof otherwise.

I feel really strong about anyone trying to profit from someone else's pictures or artwork. I had this happen to one of my teardrop campers that I built.
I have been contemplating of sending him the link to Jay's Shasta's. Just can't decide if I should get involved any more and let Jay handle it from here.
One good thing that has happened, he did pull the auctions, except for one. In his defense, the Airflyte is NOT one of Jay's works. It does look like one of the diecast models.

A few years ago, an eBay seller contacted me and threatened to sue me for using one of his photographs on my listings. It was actually a scan of a small electronic part; and it was definitely MY scan, I'd been using it for at least a year and had the original hi-res scan on my computer. Further investigation revealed that someone in the other seller's organization had taken a shortcut and grabbed my image, they'd been using it for several months! The seller apologized, he had no idea. Interesting quirk, I was threatened with a lawsuit for using my own original image! But the point is, I had proof: the original scan, high-res and time-stamped with the date of creation. One instance whete my packrat tendencies and fear of discarding anything payed off. As long as you have similar proof, your creative property is considered YOURS and copyrighted under U.S. law.

That is basically what happened to me. One of the ebay seller's people had done just that, cruised the internet, found and pulled several of my build pictures to promote the guys building plans. I contacted the seller and he pulled all of my pictures and apologized for the mistake.
I believe that the unauthorized seller of Jay's work won't put them back up, but Jay needs to be the one to jump on this and finish it. I have gotten the ebayer to drop back, but it really isn't my battle.

This is the finial chapter in the Shasta Clock saga. If you want to end this once and for all, Jay, you must contact Jim. He is and has been willing to talk with you about this issue. Now, Jim admits they are not really his designs! I have done all I can for you, Jay. Ya gotta step up to the plate and talk with Jim about your designs! I have emailed and PMed you about this, but I don't get any response from you. Here are the last emails between me and Jim. This were all from Friday the 8th until last night. He didn't have to admit to anything or even talk with me about this issue. But I sent him Jay's Flicker Link and asked him to compare, which he finally looked at them. Dear retro-rods,

I have tried several times to get Jay to contact you and I guess he has no interest in pursuing this, thus I am not going to either.
When I use to build teardrop campers, I had an ebay seller take a few of my pictures and use them in order to promote his teardrop build plans.
Jay mentioned that there were Shasta Clocks on ebay and said that those were his original designs and he hadn't given anyone permission to use them. I looked at his renderings and compared them to the yours and they are one in the same, with exception that his signature is missing from under the tongue of the Shastas.
Again, I will not bother you again with this matter, Jim. Jay has had every opportunity to get in contact with you and I guess he has no more interest in this.
